目标与内容Objectives and Content
在中国签订和履行的医疗器械国际销售合同,不仅要考虑国际公约和国际贸易惯例,而且要考虑中国的特殊法律和监管要求。销售活动中公司人员常需承担当业务与合同条款谈判的双重职责。然而,公司人员大都并非法律专业人士,对于国际销售合同条款并不总是能够透彻理解,对客户就销售合同条款提出的各种要求无法进行有效沟通。汇衡律师事务所的专业律师将就此类国际销售合同中的主要条款和常见问题进行解析,旨在让公司人员充分理解各关键条款的含义、背景、作用、以及相关法律风险,从而帮助他们提高合同谈判和控制法律风险的能力。
For those international medical instruments sale contracts executed and performed in PRC, not only the international conventions and customs but also the specific legal and regulatory requirements under the PRC laws shall be taken into consideration. In general, the company staff in the international trading activities shall be responsible for negotiation on both business and contract terms. However, as most of them are non-legal professionals, they are not always capable of fully understanding the contracts terms, which often result that they are not able to efficiently communicate with clients on their requests towards the sales contract terms. The professional attorneys from HHP Attorneys-at-Law will explain the major terms and frequently asked questions in such kind of international sales contract, aiming to help the company staff fully understand the implications, background, function and related risks in relation to the key clauses of the contact and subsequently enhance their capabilities of contracts negotiating and risk controlling.
